An ex-Boston borough councillor was Tasered by police after falling foul of the law on a night out in Boston, having just turned 35, a court was told.

Elliott Fountain, care of Norfolk Street, Boston, appeared at Boston Magistrates’ Court today (January 29) charged with being drunk and disorderly in a public place and resisting a constable in the execution of their duty in the early hours of December 27, the day after his birthday.

The ex-English Democrat councillor, who lost his seat last year for failing to turn up for any meetings for six months, pleaded guilty to both offences ... though not at first.

He initially denied the count of resisting a constable and while he entered a guilty plea to the drunk and disorderly charge did so saying “I don’t want to waste anyone else’s time”, accepting he was drunk, but appearing less willing to accept he had been disorderly.

District Judge John Stobart told Fountain he could not accept his guilty plea, after which Fountain then pleaded guilty to both charges in a manner which was acceptable to the court.

Nick Todd, prosecuting, told the court at about 3am on December 27 police saw Fountain throw a punch at another man outside the Assembly Rooms nightclub in Boston. Fountain had earlier told the court there had been an “altercation”.

Mr Todd said when the officers intervened, Fountain resisted them,leading to him being tasered.

Fountain, who was not represented, said he had suffered an injury as a result of the incident and felt as though he had been assaulted by the police.

He added he is “currently going bankrupt” and in a “very bad financial position”.

Fountain was fined £50 for being drunk and disorderly, ordered to pay a £20 victim surcharge and £85 in costs.

No separate penalty was made for the resisting a constable charge, with District Judge Stobart saying: “I feel an element of justice was done on the night.”
