A man who ‘is not a drinker’ was found to be over the limit when he was driving home from a party, Boston Magistrates’ Court has been told.

Vitalijs Jeresavs, 36, had 74 microgrammes of alcohol in 100 millilitres of breath when he was stopped on November 17. The legal limit is 35.

On Wednesday, he admitted the offence.

Mark Hudson, defending, said he had been at a party with his wife, and she had been intending to drive, but panicked as she did not know the way. He added: “He is not a drinking man. He can only apologise.”

He was banned from driving for 20 months, fined £110 and given £85 costs and a £20 surcharge.
